集体劳动关系法律调整的国际背景与中国应对——兼评《集体劳动关系法律实证研究——以集体协商为例》

Concurrently to Comment A Legal and Empirical Study on Collective Labor Relations:Based on the Analysis of Collective Consultation

  • 摘要: 新经济下集体劳动关系主体力量的变化和用工关系的改变,使集体劳动关系法律调整在全球范围内面临着挑战。集体协商秉承以人民为中心的理念,坚持“党委领导、政府主导、工会力推、各方协同、职工参与”,是应对集体劳动关系法律调整的中国方案。《集体劳动关系法律实证研究——以集体协商为例》一书,对我国集体劳动关系法律调整进行了理论拓展、实践回应和制度设计,有助于中国方案的进一步完善。

     

    Abstract: The legal adjustment of collective labor relations has been challenged all over the world, due to the changes in the subjects of collective labor relations and employment relations.Collective consultation is a Chineses scheme that adheres to the concept of people-centered and "the leadership of Party Committee, the guidance of the government, the push of trade unions, the coordination of all parties, and the participation of employers".The book "A Legal and Empirical Study on Collective Labor Relations——Based on the Analysis of Collective Consultation" makes theoretical expansion, practical response and legal system design on collective labor relations in China, which is helpful to the perfection of China's scheme.
