Abstract: As family endowment functions weakening, most single elderly people want to remarry. In order to aviod the situation that the personal or property interests of elderly people can not be protected by the laws due to cohabitation or remarriage, China should furtherly improve legal protection of elderly people's remarriage independent rights through establishing a system about elderly people's cohabitation and adding rules and regulations to protect their property in the Marriage Law, reinforcing judicial execution measures. Thus, we can reach the goal of protecting elderly people's remarriage independent rights.
